Welcome to DoodleTales! These Terms of Service ("Terms") govern your use of the DoodleTales mobile application ("App") and related services (collectively, the "Service") operated by ZippyAI Labs, LLC ("Company," "we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
You must be at least 13 years old to create an account and use the Service. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.
DoodleTales is designed for parents and guardians to create stories from their children's drawings. The Service is not intended for direct use by children under 13.

The Service offers subscription plans that provide story credits and additional features. Subscription details, including pricing and included credits, are displayed in the App.
Subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases and subscriptions.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings.
Monthly Subscription Credits: Subscribers receive 15 story credits per billing period. These monthly credits reset at the beginning of each new billing cycle. Unused monthly credits do not roll over to the next period.
Purchased Credits (Story Packs): Credits purchased through Story Packs are added to your account permanently and do not expire. Purchased credits remain available until used, regardless of your subscription status.
When generating a story, monthly credits are used first. Purchased credits are only consumed after all monthly credits have been used.
All purchases are processed through Apple's App Store. Refund requests are subject to Apple's refund policies. To request a refund, please contact Apple Support directly.
You retain ownership of all drawings, images, and voice recordings you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and use your content solely for the purpose of providing the Service to you.
You are solely responsible for your User Content. You represent and warrant that:
Stories and images generated by the Service ("Generated Content") are created using artificial intelligence. While we employ safety measures through Google's Gemini models, AI-generated content may occasionally produce unexpected results.
User Content and Generated Content are not used to train, fine-tune, or improve artificial intelligence models. All content is processed solely to provide the Service to you.

The voice cloning feature is intended for use by parents or legal guardians to create narration voices for stories. By using this feature, you represent and warrant that:
Voice recordings are processed by ElevenLabs solely to provide the requested Service. Original voice recordings are deleted within 30 days of upload.
The Service, including its original content, features, and functionality, is owned by ZippyAI Labs, LLC and is protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, you may use Generated Content for personal, non-commercial purposes, including sharing, printing, and gifting. Commercial use requires prior written consent.
The Service integrates with third-party services including:
Your use of these services is subject to their respective terms and privacy policies.
You acknowledge that these Terms are between you and ZippyAI Labs, LLC only, and not with Apple Inc. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support. To the extent permitted by law, Apple shall have no liability with respect to the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free. AI-generated content may contain errors, inconsistencies, or inappropriate material despite our safety measures.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIPPYAI LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless ZippyAI Labs, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
We may suspend or terminate your account for violations of these Terms, misuse of the Service, or to comply with legal obligations. You may delete your account at any time through the App's settings. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZippyAI Labs, LLC regarding the Service.
